Terms and Conditions

The purchase of an annual subscription to the FCI System provides a service license limited by the extent of the subscription purchased. This License constitutes an agreement between you (the end user) and FCI System Limited (hereinafter "FCI System"). This License applies to the copy of the FCI System Service programs (comprising CGI scripts, registration wizard, FCI System databases and FCI System content and information programs, hereinafter "Service") that you are now taking into use.

FCI System grants you the right to have one administrator account and the number of user accounts for which the subscription has been purchased. These are authorised users of the system which is web based and can be accessed from any computer terminal at any time. You may not use, copy, modify, adapt, translate, reverse engineer, decompile or disassemble the Service, except as permitted hereunder or to the extent such acts may not be prohibited by law in the country of use, or create derivative works based on the Service. The FCI System copyright should be acknowledged at all times, and the disclaimer therein read and understood. All rights not expressly granted are reserved by FCI System.

You acknowledge that this License is personal to you and neither this License nor the Service may be transferred, sub-licensed or otherwise assigned. Any export of the Service is subject to the requirements and restrictions of applicable laws and regulations.

FCI System warrants that the Service will perform with normal use substantially in accordance with the accompanying material for the duration of your subscription. This warranty is void if failure of the Service has resulted from accident or misuse. Any replacement of the Service will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.

FCI System entire liability and your exclusive remedy in the event that a valid claim is made by you to FCI System within the terms of the aforesaid warranty, shall be either the return of the price paid by you for the License of the Service (if any) or, at FCI System option, the repair or replacement of the Service.

FCI System and its licensors disclaim all other conditions or warranties express or implied, statutory or otherwise which are hereby expressly excluded to the extent permitted by law. For the avoidance of doubt, neither FCI System nor its licensors warrant the quality or accuracy of any information or documentation resulting from or transmitted using the Service. There is no warranty by FCI System or any other party or person that the functions contained in the Service will meet your requirements or that the operation of the Service will be uninterrupted or error-free. You assume all responsibility for the selection of the Service to achieve your intended results, and for the installation, use and results obtained from it.

Neither FCI System nor its licensors shall be liable for any indirect, special or consequential loss, or loss of profits, loss of revenue, loss of business, loss of use, loss of contracts, anticipated savings or for any economic or financial loss whatsoever and howsoever suffered, even if FCI System has been advised of the possibility of such damages.

These Terms & Conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersede and replace all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provision of these Terms & Conditions will be effective only if in writing and signed by the Directors of FCI System Limited. Any purchase of a subscription to FCI System Limited services assume that the Terms & Conditions stated above have been agreed to.
